General Terms and Conditions
1. Vanhoucke Law BV is a private limited liability company (civil company in the form of a BV) incorporated under Belgian law, with the purpose of practicing law in the broadest sense of the word. Its lawyers are registered with the Antwerp Bar, Bolivarplaats 20, 2000 Antwerp.
2. These general terms and conditions apply to all services provided by Vanhoucke Law BV, its partners, associates, and staff.
3. The liability of Vanhoucke Law BV, its partners, and associates is limited to the net insured amount under its professional liability insurance. Professional liability is covered by a collective insurance policy subscribed by the Flemish Bar Association with insurance company Amlin Insurance. Should no payment be made under that insurance for any reason, the liability of Vanhoucke Law BV, its partners, associates, and staff is limited to the amount of fees paid by the client for the services provided by Vanhoucke Law BV that give rise to the liability.
4. All rates are exclusive of VAT. Invoices are payable within 14 days of issue. In the event of late payment, statutory interest shall be due automatically and without prior notice, until full payment is made. In such case, a fixed fee of 10% of the principal sum, with a minimum of EUR 50.00, shall also be payable for administrative and extrajudicial collection costs.
5. Vanhoucke Law BV is subject to the Act of 11 January 1993 on the prevention of the use of the financial system for the purpose of money laundering and terrorist financing. Pursuant to this legislation, Vanhoucke Law BV is required to identify its clients and request and retain certain supporting documents. If facts are established which the firm knows or suspects to be related to money laundering or terrorism, information must, in accordance with this legislation, be transmitted to the President of the Bar. The latter decides whether or not the information should be communicated to the Financial Intelligence Processing Unit.
6. The legal relationship governed by these general terms and conditions shall be governed by and construed in accordance with Belgian law. Disputes shall be submitted exclusively to the courts of the judicial district of Antwerp.
